1. Acceptance of Terms

By creating an account, accessing, or using Genvas (the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or a prominent notice on the platform.

2. Description of Service

Genvas is a software-as-a-service (SaaS) platform that provides access to AI-powered video generation tools. The Service allows users to create videos from text prompts and/or images using various third-party AI models.

Genvas is an independent product and is not affiliated with, endorsed by, or sponsored by Google, OpenAI, Kuaishou, or any other AI model provider. We provide access to various AI models through our platform as a service aggregator.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this age requirement.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Credits and Payment

The Service operates on a credit-based system. Credits are required to generate videos and are consumed based on the model, duration, resolution, and other parameters selected.

Credits may be obtained through: (a) free registration bonuses, (b) subscription plans, or (c) one-time credit package purchases. All payments are processed through our third-party payment provider.

Subscription plans auto-renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

All purchases are final and non-refundable, except as required by applicable law. Unused credits from subscription plans expire at the end of each billing cycle. One-time purchased credits remain valid for the period specified at the time of purchase.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You are solely responsible for all prompts, images, and other content you submit, as well as all generated outputs under your account.

You may not use the Service to: (a) generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) create deepfakes or misleading content intended to deceive others; (c) infringe upon any third party's intellectual property rights; (d) generate content depicting minors in inappropriate contexts; (e) attempt to reverse-engineer, decompile, or extract the underlying AI models; (f) resell or redistribute the Service without authorization; (g) use automated scripts or bots to access the Service in an abusive manner.

We reserve the right to review generated content and suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

Subject to compliance with these Terms, you retain ownership of the content you create using the Service, including text prompts and uploaded images. You are granted a license to use the AI-generated video outputs for personal and commercial purposes.

You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions. We make no representations regarding the copyrightability of generated outputs.

The Genvas name, logo, and all related branding elements are our trademarks. You may not use our trademarks without prior written consent.

7. Third-Party AI Models

The Service provides access to video generation models from third-party providers. The quality, speed, and availability of AI-generated content depends on the underlying model providers and may vary.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated output. Generation results may differ based on model capabilities, server load, and other factors beyond our control.

Third-party model providers may update, modify, or discontinue their models at any time, which may affect the availability of certain features on our platform.

8. Service Availability

We strive to maintain high uptime, but we do not guarantee uninterrupted, error-free, or secure access to the Service. We may update, suspend, or discontinue parts of the Service at any time for maintenance, upgrades, security, or compliance purposes.

In the event of scheduled maintenance, we will make reasonable efforts to provide advance notice. We are not liable for any downtime or service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the Service will be accurate or reliable; (d) any errors in the Service will be corrected.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GENVAS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Account Termination

You may delete your account at any time through your account settings. Upon deletion, your data, including generated videos and account information, will be permanently removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms or engaged in fraudulent or abusive behavior. In such cases, any remaining credits will be forfeited.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
